Lead-Based Paint Occupation Accreditation and Certification Regulations

Federal Laws:
Congress passed the residential Lead-Based Paint Hazard Reduction Act of 1992, also known as Title X, to protect families from exposure to lead from paint, dust, and soil.  

Lead Disclosure Rule - Section 1018 of Title X (enforced by HUD and EPA) requires the disclosure of known information on lead-based paint and lead-based paint hazards before the sale or lease of most housing built prior to 1978.  This requirement affects most real estate transactions (sale or rental) of post private housing, public housing, Federally owner housing, and housing receiving Federal assistance. Renovation, Repair and Painting RuleThe RRP rule broadly applies to renovation, repair or painting activities performed for compensation that disturb painted surfaces in target housing and child occupied facilities.  An occupanying rule known as the Lead Safe Housing Rule applies to those homes receiving funding from the US Department of Housing and Urban Development.  In general those disturbing lead based paint during renovation or repairs need to provide education/outreach regarding the potential hazards of work involving lead based paint, only have certified/trained staff and companies completing the lead related lead work, as well as practice lead safe housing practices.
