Notice is hereby given that the ZONING HEARING BOARD will have a special meeting in Town Hall, 10 E. Church Street, Bethlehem, PA, on Wednesday, December 13, 2006 at 7:00 PM, for the purpose of hearing the following appeals.


1. 724-726 E. Fifth Street
Appeal of the Affordable Housing Alliance for dimensional variances from the Area, Yard and Building regulations to create a two-lot subdivision, with lot 1 (724 E. Fifth) having an existing warehouse and one residential use, and on lot 2 (726 E. Fifth) will be constructed a Single Family Detached Dwelling. (Articles 1308.03 refers to 1318.01, 1318.03, Table A-2, and 1325.06; required minimum side yard setback on each side of (lot 1) – 4’, proposed – 3’ and 1.5’; for (lot 2), required minimum side yard setback 5’ one side, proposed – 1’; required minimum lot width for each lot -30’ for each, proposed – 20’’; required lot area per dwelling – 3,000 square feet, proposed 2,800 square feet for each lot)

2. 730 W. Union Boulevard
Appeal of Domenic Villani for (1) an interpretation on whether the property consists of 5 or 6 dwelling units. (2) If the interpretation allows for 5 units, applicant requests a dimensional variance from the minimum lot requirements for 6-units, (3) a variance from the parking lot design standards for 11 vehicles, and (4) an appeal from the Cease and Desist for a use variance to allow a contractor storage on the property. (Lot area required for 6 units – 36,000 square feet, proposed – 14,100 square feet. Required parking area distance from the property line – 10’, proposed – 1’6”. Relief from the required buffering and screening between the parking lot and the abutting residential property and property across the street and alley ; Minimum width of an aisle for two way traffic – 25’, proposed – 24’. Appeal of Sara M. Cox for a dimensional variance to construct a second floor rear addition and porch on an existing single family detached dwelling. (Required side yard setback – 4’, proposed – 2’, Articles 1307.03, 1318.01, 1318.14, Table A – 2, 1323.04.d.5, 1325.06)

4. 820 Eaton Avenue
Appeal of Joseph K. and Nalyn Russo Marcus for dimensional variances to convert from a single family detached dwelling to a chiropractic office. (Required lot width – 150’, proposed – 70.5’; Required setback from proposed office building to the lot line of an abutting residential use property – 100’, proposed – less than 5 feet on the east side and less than 30’ on the west side. Articles 1314.B.03.a.2, 1314.B.03.a.3.I, 1325.06.

5. 619 Broadway
Appeal of Alliance for Building Communities for a use variance and a dimensional variance from the required off-street parking requirements to occupy the first floor of a 3-story building with an office. The second and third floors (combined) will be occupied by one dwelling. (1308.02.a, 1319.01.a.18, required parking – minimum 1 space, proposed – 0)

6. 742 Shield Street
Appeal of Housing Opportunity Movement, Inc. for a dimensional variance from the steep slope requirements to create a 4 lot subdivision and construct a single family semi-detached dwelling on each lot, and a dimensional variance from the minimum lot depth. (Minimum required lot size – 1 acre, proposed – 2795 square feet; required lot depth – 100’, proposed – 80’. Articles 1318.29.c.1, 1308.03, 1318.01, Table A-2 Footnote 3, 1325.06.
