731.01 PUBLIC NUDITY PROHIBITED.

No person shall knowingly or intentionally, in a public place, appear in a state of nudity. This Section shall not apply to public nudity necessarily incident to breast feeding a child.

731.02 DEFINITION.

As used in this Article, "Nudity" means the showing of the human male or female genitals, pubic area, or buttocks with less than a fully opaque covering, the showing of the female breast with a less than fully opaque covering of any portion thereof below the top of the nipple, or the showing of covered male genitals in a discernibly turgid state.

731.99 PENALTY.

Any person who violates any provision of this Article shall be subject to the following penalties:

(a) First Violation - A fine of $250.00, or thirty days imprisonment, or both;

(b) Second Violation - A fine of $500.00, or sixty daysimprisonment, or both;

(c) Third and each subsequent violation - A fine of $1,000.00, or ninety days imprisonment, or both.
